1. Introduction

Welcome to OceaniaCloud. These Terms of Service (“Terms”) govern your use of our website, hosting, domain, and related services (the “Services”). By signing up or using our Services, you agree to these Terms. If you do not agree, you may not use the Services.

2. Eligibility & Accounts

You must be at least 18 years old to use our Services.
You agree to provide accurate information when creating an account.
You are responsible for keeping your login details secure and all activity under your account.

3. Services

Our Services include hosting, domain registration, email services, and related features. You are responsible for ensuring your use of the Services complies with all applicable laws.

4. Acceptable Use Policy (AUP)

You agree not to misuse our Services. Prohibited uses include, but are not limited to:

Sending unsolicited bulk email (“spam”), chain letters, or abusive messages.
Hosting or distributing malware, phishing pages, or harmful code.
Infringing intellectual property rights or hosting pirated content.
Using Services for denial-of-service (DoS/DDoS) attacks, hacking, or network scanning.
Running crypto-mining software or resource-intensive background processes without prior approval.
Using excessive system resources beyond fair usage limits (CPU, memory, I/O, storage, or email sending limits).
Violating Australian law or applicable international regulations.

OceaniaCloud may suspend or terminate Services that breach this policy. Repeated or serious violations may result in immediate termination without refund.

5. Payments & Billing

Services are billed in advance on a recurring basis (monthly, annually, or as agreed).
All fees are in AUD.
Hosting plans include a 30-day money-back guarantee for first-time purchases. Domain registrations, SSL certificates, third-party licences, and once-off services are non-refundable.
Refunds (where applicable) will be issued minus any payment gateway fees or transaction charges incurred.
Unpaid invoices may result in suspension or termination of Services.

6. Service Availability & Support

OceaniaCloud aims for 99.9% uptime, excluding maintenance, force majeure, or third-party failures.
Standard support is provided through our ticket system.
We are not responsible for issues caused by your own software, themes, plugins, or third-party providers.

7. Domains & Email

Domain registrations and renewals follow the rules of the relevant registry (e.g., auDA for .au). WHOIS privacy is not available for .au domains per registry policy.
Email accounts included with hosting are intended for standard use. For business-critical email, consider enterprise services such as Google Workspace or Microsoft 365.

8. Data & Backups (30-Day Retention)

You are responsible for maintaining your own backups.
OceaniaCloud performs automated daily backups, with backup copies retained for 30 days for disaster-recovery purposes.
Backup restoration is subject to availability and technical feasibility and is not guaranteed (e.g., if data is corrupted or falls outside retention).
Data may be deleted permanently after service cancellation or termination.

9. Termination & Cancellation

You may cancel Services through the client portal before the next renewal date.
We may suspend or terminate Services for:

Breach of these Terms or the AUP
Non-payment of fees
Activities that disrupt or harm our systems or customers

If data restoration is possible after termination, recovery may be offered subject to availability and applicable fees.

10. Amendments

We may update these Terms from time to time. The latest version will be available on our website. Continued use of the Services after changes take effect means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes will be handled in the courts of South Australia.
